Deze COI Focus Algemene situatie biedt een overzicht van een brede waaier van relevante en actuele COI-bronnen over Kosovo. Het gaat hierbij over COI-bronnen van de Europese instellingen (Europese Commissie, Raad van Europa, de European Asylum Support Office (EASO)); van andere lidstaten van de Europese Unie (EU) en van het Amerikaanse ministerie van Buitenlandse Zaken. Ook heeft Cedoca een aantal rapporten van verschillende internationale organisaties geconsulteerd: Het gaat hier over verschillende organisaties van de Verenigde Naties (United Nations High Commissioner for Refugees, UNHCR en het United Nations Development Programme, UNDP) en over niet-gouvernementele organisaties (Freedom House, Amnesty International, Human Rights Watch, de Bertelsmann Stiftung, Reporters Without Borders). Ten slotte zijn ook een aantal Kosovaarse bronnen opgenomen zoals bijvoorbeeld de Dienst van de ombudsman.

Bijzondere aandacht in dit overzicht gaat naar de zogenoemde Progress Reports van de Europese Commissie (EC). In deze rapporten evalueert de EC de lokale implementering van het EU-uitbreidingsbeleid voor Kosovo. Dit uitbreidingsbeleid is gebaseerd op vooropgestelde criteria waarvan sommige ook relevant zijn in dit COI-overzicht.

Sinds jaren volgt de Balkandesk van Cedoca de situatie in Kosovo op de voet. Dit document is een actualisering van een eerder overzicht van de situatie in Kosovo, gepubliceerd op 10 juli 2018. Het is aangevuld met informatie uit de periode van augustus 2018 tot juli 2020. Na de vervroegde parlementsverkiezingen van 14 februari 2021 heeft Cedoca nog de resultaten hiervan toegevoegd aan dit document.

Deze COI Focus is opgevat als een compendium en maakt bijgevolg geen synthese van de verzamelde informatie.

Policy

The policy implemented by the Commissioner General is based on a thorough analysis of accurate and up-to-date information on the general situation in the country of origin. This information is collated in a professional manner from various, objective sources, including the EASO, the UNHCR, relevant international human rights organisations, non-governmental organisations, professional literature and coverage in the media. When determining policy, the Commissioner General does not only examine the COI Focuses written by Cedoca and published on this website, as these deal with just one aspect of the general situation in the country of origin. The fact that a COI Focus could be out-of-date does not mean that the policy that is being implemented by the Commissioner General is no longer up-to-date.

When assessing an application for asylum, the Commissioner General not only considers the actual situation in the country of origin at the moment of decision-making, he also takes into account the individual situation and personal circumstances of the applicant for international protection. Every asylum application is examined individually. An applicant must comprehensively demonstrate that he has a well-founded fear of persecution or that there is a clear personal risk of serious harm. He cannot, therefore, simply refer back to the general conditions in his country, but must also present concrete, credible and personal facts.
